These terms of use (the “Terms”) tell you the rules for using our website www.habstash.com (the “Site”) and for registering with us by opening an account with us (the “Habstash Account”).

In these Terms, references to “Habstash”, “we”, “us”, “our” and/or “ourselves” means Finanum Limited. References to “customer”, “you” and/or “your” means any person who opens a Habstash Account with us.

Reference to a “Habstash Account” means the account that we will open for you which will enable you to manage your home savings goal.

By using our Site or opening a Habstash Account, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree with these Terms, then you must not use our Site nor open an account with us.

These Terms also refer to our Privacy Policy: https://www.habstash.com/privacy-policy which applies to your use of the Site and opening a Habstash Account. Our Privacy Policy, which sets out the terms on how we process any personal data we collect from you or that you provide to us. By using our Site and opening an account with us, you consent to such processing and you warrant that all data provided by you is accurate.

c. Changes to Terms

We may amend these Terms from time to time. Please review these Terms each time you visit our Site or log in to your Habstash Account, as you will be bound by them.

Habstash is the trading name of Finanum Limited, a company registered in England and Wales with company number 10430883 whose registered office is at 10 Cheltenham Court, 30 Marsh Lane, Stanmore, England, HA7 4HE.

3. Reliance on content

The content on our Site and through your Habstash Account is provided for general information purposes only and is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Site or your Habstash Account.

We will make reasonable efforts to update the information on our Site and your Habstash Account, but we make no representations, warranties or guarantees, whether express or implied, that the content on our Site and your Habstash Account is accurate, complete or up to date.

We do not guarantee that our Site or your Habstash Account or any content on either is or will be free from errors or omissions.

4. Site availability and access

Our Site is aimed at people residing in the United Kingdom. The content on the Site may not be appropriate or available for use in locations outside the United Kingdom. If you choose to access our website from outside the United Kingdom, you do so at your own risk.

Accessing our Site and opening your Habstash Account are both free of charge, but we cannot guarantee that operating your Habstash Account will always be free of charge.

We may update and change our Site from time to time to reflect changes in our products, our users’ needs and business priorities.

We do not guarantee that our Site or your Habstash Account, or any content on either, will always be available or be uninterrupted.

We may suspend or withdraw, change or restrict the availability of all or any part of our Site or your Habstash Account for business and operational reasons without notice.

Some areas of our Site may be restricted to those people who have registered with us.

5. Account registration

Normally, you must be 18 or over to open a Habstash Account. If you are under 18 and we let you have a Habstash account, we will let you know any special terms and conditions that apply.

Each user may only register one account. User accounts cannot be shared with other people except with persons with whom you are intending to buy a home.

Please keep your details in the dashboard within your Habstash Account up to date and let us know immediately if any information you’ve provided changes.

You can close your account at any time by letting us know through the dashboard within your Habstash Account.

We may close or suspend your account immediately, and end your access to our Site, in exceptional circumstances. Exceptional circumstances include, for example the following:

• If you have materially breached any of the Terms and you haven't put the matter right within a reasonable time of us asking you to;
• If we have good reason to believe that your use of our Site and your Habstash Account is harmful to us or our software, systems or hardware;
• If we have good reason to believe that you continuing to use your account could damage our reputation or goodwill;
• If we have to do so under any law, regulation, court order or ombudsman’s instructions.

We may also decide to close or suspend your account for other reasons. We would contact you before we do this.

6. Account details

If you have account details to access your Habstash Account, such as a password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

If you believe or suspect that someone else knows your password and/or may have unauthorised access to your Habstash Account, you must notify us immediately.

If we believe that there has been a breach of security in relation your account details or we believe that your Habstash Account has been compromised then we may lock your account and require you to change your password.

We reserve the right to disable any password or suspend your Habstash Account at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

7. Misuse of our Site

You may only use our Site and your Habstash Account for lawful reasons.

You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.

You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site.

You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site and your Habstash Account will cease immediately.

8. Third party links and resources

Our Site or your Habstash Account may contain links to other websites and resources provided by third parties. These links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for any loss or damage suffered due to your use of them. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

9. Linking to our Site

You may link to the homepage of our Site, provided you do so in a way that is fair and legal, does not damage our reputation or take advantage of it and that does not suggest any form of association, approval or endorsement on our part where none exists.

We reserve the right to withdraw linking permission without notice.

Habstash and the Habstash logo are trade marks of Finanum Limited. You are not permitted to use them without our approval, unless they are part of material you are using as permitted under this section.

We grant to visitors of the Site a non-exclusive revocable licence to view and print the content appearing on the Site or any part of it including and not limited to email communications, subject to the following conditions:

• You may print off one copy of any page(s) from our Site for your own personal use (but not for commercial use);
• You may download extract(s) from our Site for your own personal use (but not for commercial use);
• You must not modify the paper or digital copies of any materials or content you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

The Terms is governed by the laws of England and Wales. If any provision of the Terms is or becomes invalid or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision will be treated as if it were not in the Terms, and the remaining provisions will still be valid and enforceable.

13. Applicable law

Your use of our Site and your Habstash Account and any dispute arising out of that use is subject to the laws of England and Wales.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
